Terms of Service
Last updated: April 30, 2026
These terms cover your use of Automarkly. Plain English where possible. By creating an account or submitting homework, you agree to these terms.
What Automarkly does
Automarkly grades homework photos using an AI model and emails results back to your family. The grading is automatic and usually accurate, but it is not perfect. Always review the results before treating them as final.
Your account
- You’re responsible for keeping your account credentials secure.
- You must be at least 18 years old, or the parent/guardian of the students you add.
- You may only add students who are members of your household or whom you supervise.
- You may not share your account with people outside your household. To give a co-parent or partner access, use the “Invite member” flow.
Acceptable use
You may not use Automarkly to:
- Submit content that isn’t your student’s homework — including copyrighted material you don’t have rights to, or other people’s work.
- Submit content that’s harmful, illegal, or harassing.
- Attempt to bypass our usage limits, reverse-engineer the service, or interfere with other accounts.
- Use the service for academic dishonesty in a context where automated grading isn’t allowed.
Plans and billing
- The Free plan is free to use within its weekly credit and storage limits.
- Paid plans (when launched) bill monthly. You can cancel any time from settings; cancellation takes effect at the end of the billing period.
- We don’t offer prorated refunds for partial months, but contact us if something went wrong and we’ll do the right thing.
- Plan limits are enforced per family, not per individual member.
Grading accuracy
Automarkly does its best to grade accurately, but:
- It can mis-read messy or ambiguous handwriting.
- It may flag unclear answers for you to review rather than guess.
- It can be wrong on judgment calls (alternative valid methods, partial credit, etc.).
If you disagree with a grade, use the dispute or override controls on the report. Don’t use Automarkly as the sole source of truth for academic decisions.
Your data
How we collect, use, and store your data is described in our Privacy Policy.
Photos and grading results belong to you. You can export or delete them at any time. We don’t use your homework to train AI models.
Service availability
We aim for high uptime but don’t guarantee it. The service is provided “as is” without warranties of any kind. We may change, suspend, or discontinue features (with reasonable notice for paid plans).
Liability
To the extent allowed by law, Automarkly is not liable for indirect, incidental, or consequential damages — for example, academic consequences from a wrongly-graded answer. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
Termination
- You can delete your account at any time from settings.
- We may suspend or terminate accounts that violate these terms, abuse the service, or fail to pay. We’ll usually warn you first unless the violation is severe.
Changes
If we change these terms in a meaningful way, we’ll email active users at least 14 days before the change takes effect. Continued use after that means you agree to the new terms.
